Terms of Service

The agreement between you and WayFolk. We’ve kept it as plain as we can.

The short version

  • You must be at least 16 to use WayFolk.
  • Be decent: no harassment, hate, illegal, or objectionable content. You can report and block anyone, and we act on reports.
  • You own your content. You give us only the permission we need to run the service.
  • Horizons is an auto-renewing subscription billed by Apple or Google. You can cancel anytime in your store settings (section 8).
  • You can delete your account anytime from inside the app.
  • You keep all your rights as an EU consumer, and you can bring disputes in your home country (section 14).

1. About these terms

WayFolk is operated by Wayfolk OÜ (registry code 14940095), P. Süda tn 3–4, 10118 Tallinn, Estonia (“WayFolk”, “we”, “us”). These terms are a binding agreement between you and WayFolk that governs your use of the WayFolk app and website (the “Service”). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use WayFolk.

2. Who can use WayFolk

You must be at least 16 years old to use WayFolk. If you are under the age of majority where you live, you confirm that your parent or legal guardian has reviewed and agreed to these terms with you. You must also be legally permitted to use the Service where you are, and not barred from it under any applicable law.

3. Your account

  • You sign in with your phone number using a one-time code sent by SMS. You can add an email address for account recovery. Keep your account and device secure; you’re responsible for activity under your account.
  • Provide accurate information and keep it current. Don’t impersonate anyone or misrepresent who you are.
  • One person, one account. Don’t share your account or transfer it to anyone else.
  • Tell us promptly at [email protected] if you think your account has been compromised.

4. Acceptable use and community rules

WayFolk has zero tolerance for objectionable content and abusive behaviour. By using WayFolk you agree not to post, send, or share content, and not to behave, in any of the following ways:

  • Harassment, bullying, threats, hate speech, or content that demeans people based on who they are.
  • Sexual content involving minors, or any content that sexualises a child — this results in an immediate ban and reporting to the authorities.
  • Pornographic, violent, graphic, or otherwise obscene or objectionable content.
  • Illegal activity, fraud, scams, spam, or promotion of self-harm or dangerous acts.
  • Impersonation, fake accounts, or falsifying your location or identity.
  • Sharing other people’s private information without permission.
  • Scraping, reverse-engineering, probing, overloading, or interfering with the Service or its security; using bots or unauthorised automated access; or uploading malware.
  • Using WayFolk to send unsolicited marketing, or for any commercial purpose we haven’t agreed to.

You also confirm that you have the right to share any contact you upload for matching, and any content you post.

5. Safety, reporting and moderation

You can report content, people, communities, or Travel Groups, and block anyone, from inside the app. We review reports of objectionable content and abusive users and aim to act on them — by hiding or removing content and, where warranted, suspending or removing the user — within 24 hours. Content reported by several people may be hidden automatically while we review it. We may remove content or restrict or end accounts that breach these terms or the law, with or without notice where necessary to protect people.

If we remove your content or suspend your account, we will tell you why where we can, and you can ask us to review the decision by contacting [email protected].

Where content or conduct may involve a crime or a serious risk of harm to others, we may report it to, and cooperate with, law enforcement and other authorities — and where someone may be in danger, we treat that as a priority.

WayFolk is not an emergency service. If you are in danger, contact your local emergency number.

6. Your content and the licence you give us

You own the content you create on WayFolk — your profile, photos, messages, and posts. To operate the Service, you give WayFolk a limited, worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display your content solely to provide and improve the Service (for example, showing your profile to people you connect with, or delivering your messages). This licence is only as broad as needed to run WayFolk, and it ends when you delete the content or your account — except for copies that other users have received (such as messages already delivered) or that we must keep by law, and for reasonable backup copies that cycle out over time.

If you send us feedback or suggestions, you allow us to use them to improve WayFolk without obligation to you.

7. Other people and real-world meetings

WayFolk helps you find and connect with people, including people who travel where you do. We do not verify the identity or background of users. You are responsible for your own interactions and for deciding who to meet and where. Use good judgement, meet in public where appropriate, and tell someone your plans. We are not responsible for the conduct of any user, online or offline, to the extent the law allows.

8. Horizons subscription, billing and cancellation

WayFolk is free to use. Horizons is an optional paid subscription that unlocks additional features. The available plans, their length, price, and exactly what’s included are shown to you in the app at the time of purchase, before you confirm.

Auto-renewal

Horizons is an auto-renewing subscription. Unless you cancel, it automatically renews at the end of each period at the price shown when you subscribed, and your store account is charged for the next period. Renewal continues until you cancel.

Billing

Horizons is billed by Apple (App Store) or Google (Google Play) through your store account, depending on where you downloaded WayFolk. We do not receive or store your card or payment details. Your purchase is also subject to the app store’s own terms.

Cancelling

You can cancel anytime, and you’ll keep access until the end of the period you’ve paid for. Cancellation is managed through your store account:

  • Apple: Settings → your name → Subscriptions → WayFolk → Cancel.
  • Google: Google Play → Profile → Payments & subscriptions → Subscriptions → WayFolk → Cancel.

To avoid being charged for the next period, cancel at least 24 hours before it begins, as required by the stores.

Price changes

If we change the price of a plan, we’ll tell you in advance and the new price will apply only to future periods; the stores will ask for your agreement where required before charging a higher price.

Your EU right to cancel (“cooling-off”), and refunds

As an EU/EEA consumer you normally have 14 days to withdraw from a purchase of digital content. Because Horizons gives you immediate access to its features, when you subscribe you ask us to start the service immediately and acknowledge that your 14-day right of withdrawal is lost once the service has been fully provided; for an auto-renewing subscription this applies to the period in progress.

Refunds for app-store purchases are handled by Apple or Google under their policies, not by WayFolk — Apple, in particular, may offer refunds beyond the legal minimum. Nothing here limits any mandatory refund or consumer right you have under the law where you live.

9. Our intellectual property

WayFolk, the WayFolk name and logo, the app, the website, and their design and software are owned by Wayfolk OÜ and protected by intellectual-property laws. We give you a personal, limited, non-exclusive, non-transferable, revocable right to use the Service as intended. You may not copy, modify, distribute, or create derivative works from WayFolk except as the law allows.

10. Availability and changes to the service

We work to keep WayFolk available and improving, and we may add, change, or remove features over time. We may occasionally suspend the Service for maintenance or for reasons outside our control. We don’t guarantee the Service will always be uninterrupted or error-free.

11. Suspension and ending your account

You can delete your account at any time from inside the app (Settings → Account). Deletion removes your account and personal data as described in the Privacy Policy; some information may be retained where the law requires or to keep other people’s conversations intact (anonymised). Deleting WayFolk does not cancel an active store subscription — cancel that in your store settings (section 8).

We may suspend or end your access if you breach these terms or the law, if needed to protect other users or WayFolk, or if we’re required to. Where reasonable and lawful, we’ll give you notice and a chance to respond.

12. Disclaimers

We provide WayFolk with reasonable skill and care. To the extent permitted by law, the Service is provided “as is” and we don’t make promises about it beyond those set out in these terms or required by law. This section does not limit your mandatory rights as a consumer, including your statutory rights in respect of services that are not provided as agreed.

13. Our liability

Nothing in these terms limits or excludes our liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence, for fraud or intentional wrongdoing or gross negligence, under the EU Product Liability rules, or for any other liability that cannot be limited under the law that applies to you.

Subject to that, and to the extent permitted by law, WayFolk is not liable for loss that is not reasonably foreseeable, for the conduct of other users, or for events outside our reasonable control.

14. Governing law and disputes

These terms are governed by the laws of Estonia. If you are a consumer in the EU/EEA, you keep the protection of the mandatory laws of the country where you live, and you can bring proceedings in the courts of your home country. There is no mandatory arbitration and no class-action waiver.

You can also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr, and for data-protection complaints you can contact the Estonian Data Protection Inspectorate (see the Privacy Policy). We’d always rather sort things out directly first — email [email protected].

15. Changes to these terms

We may update these terms as WayFolk evolves. If we make a material change, we’ll update the “last updated” date and let you know in the app or by email before it takes effect, so you can review it. If you keep using WayFolk after a change takes effect, that means you accept the updated terms; if you don’t agree, you can delete your account.
